Your contract is governed by Italian law and by the EU rules that protect package travellers (Directive (EU) 2015/2302), wherever you live. The Italian version of this text is the binding one. The trip we offer you is a package within the meaning of Directive (EU) 2015/2302 and the Italian Tourism Code (Legislative Decree 79/2011, as amended by Legislative Decree 62/2018). You therefore enjoy all the rights the law gives to people who buy a package: we are responsible for the whole trip, from departure to return, and a guarantee protects your payments should we be unable to continue trading. Here we summarise those rights in our own words; the official standard form reaches you as a PDF together with the proposal.
Before you travel
- You know everything before you accept. Before confirming, you receive in writing, in the proposal, the essential information on the trip: services, dates, itinerary, accommodation, total price including taxes and charges, payment schedule, minimum number of participants where applicable, passport and visa information, cancellation charges and insurance (art. 34 of the Tourism Code).
- You receive the contract and can keep it. As soon as you accept, we email you the contract as a PDF, with all the agreed information and the contact details for asking us for help (art. 36). The information in the proposal can change only with your agreement (art. 35).
- One party is responsible. We are responsible for all the services in the package, even when others provide them: airlines, lodges, guides and local ground handlers (art. 42).
- You can transfer the trip. If you cannot travel, you can transfer the contract to another person who meets the requirements for the trip, notifying us in writing at least 7 days before departure. You and your replacement are jointly liable for the balance and for the costs of the transfer, which we tell you in advance and which correspond to the actual expenses (art. 38).
- The price is fixed, with three exceptions. It can rise only if the contract allows it and only because of fuel costs for transport, taxes and fees imposed by third parties, or exchange rates. Any increase must be notified with the calculation and never in the last 20 days before departure; if it exceeds 8% you can cancel free of charge. If those costs fall, you are entitled to a reduction (art. 39).
- You decide on significant changes. If before departure we have to change significantly an essential element of the trip, you can accept the change, choose an alternative if we offer one, or cancel free of charge, with a refund within 14 days (art. 40).
- You can cancel at any time. Before departure you can cancel by paying the charges set in the contract, which must be appropriate and justifiable. You pay nothing, and get everything back, if unavoidable and extraordinary events at or near the destination compromise the trip, such as a conflict or a natural disaster (art. 41).
- If we cancel, we refund everything. If we cancel the trip before departure we refund in full what you have paid within 14 days and, unless the cancellation is due to the minimum number of participants not being reached or to unavoidable and extraordinary circumstances, we compensate you (art. 41).
During the trip
- If something goes wrong, we put it right. Tell us straight away about any service that differs from what was agreed: we must remedy it unless this is impossible or excessively costly. If we do not, you are entitled to a price reduction and compensation, including, in the most serious cases, damages for a ruined holiday. If the problem is serious and we do not solve it, you can end the trip without charge and, if transport is included, your return is at our expense (arts. 42, 43 and 46).
- You are not on your own. If you are in difficulty we help you with information on health services, local authorities and consular assistance, with communications and with alternative travel arrangements. If your return is impossible because of extraordinary events, the necessary accommodation for up to three nights is at our expense (arts. 42 and 45). During the trip you have an assistance number available 24 hours a day.
- Every complaint gets an answer. You can send us a written complaint and receive a reasoned reply; if you are not satisfied you can turn to an alternative dispute resolution body or to the court of the place where you live.
If the organiser becomes insolvent
- Your money is protected. Every organiser must have protection against insolvency and bankruptcy. If we were unable to continue trading, the guarantor refunds what you paid for services not yet received and, if you are already travelling with transport included, arranges your return. You can contact the guarantor directly, without going through us (art. 47).
